Please read these Terms of Use (“Terms”) carefully before using the website located at https://n1flooring.com (“Site”), operated by N1 International Flooring LLC (“N1 Flooring,” “we,” “us,” or “our”), a limited liability company organized under the laws of the State of Georgia, United States. By accessing or using this Site, placing an order, or otherwise engaging with our services, you (“User,” “you,” or “your”) agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must immediately discontinue use of this Site.

1. Use of the Site

You agree to use this Site only for lawful purposes and in a manner consistent with these Terms. You must not:

  • Use the Site for any fraudulent, deceptive, or illegal purpose;
  • Attempt to gain unauthorized access to any portion of the Site or its related systems;
  • Transmit any harmful, offensive, or disruptive content;
  • Reproduce, duplicate, or resell any portion of the Site without our express written consent;
  • Use automated tools (bots, scrapers, crawlers) to access, collect data from, or interact with the Site.

We reserve the right to suspend or terminate your access to the Site at any time, without notice, for any violation of these Terms.

2. Eligibility

This Site is intended for use by individuals who are at least 18 years of age and are capable of entering into a legally binding contract. By using this Site, you represent and warrant that you meet these requirements.

3. Customer Categories and Pricing

3.1 Retail Customers (Homeowners)

Individuals purchasing flooring products for personal, residential, or non-commercial use are classified as Retail Customers. Retail pricing applies to all transactions made under this category. Misrepresentation of your customer category to obtain preferential pricing may result in cancellation of your order, retroactive price adjustment, and termination of your account.

3.2 Trade / Business Customers

Licensed contractors, flooring dealers, interior designers, property developers, and other businesses purchasing products for commercial resale or professional use may apply for Trade Account status. Trade pricing is available exclusively to approved accounts and is contingent upon:

  • Submission of valid business documentation (e.g., business license, resale certificate, or contractor license);
  • Ongoing compliance with these Terms;
  • Continued eligibility as determined solely by N1 Flooring.

Trade pricing and discounts are confidential. You agree not to disclose trade pricing to third parties. N1 Flooring reserves the right to revoke Trade Account status at any time, at its sole discretion.

3.3 Account Accuracy

You are solely responsible for providing accurate information when creating an account or placing an order. N1 Flooring is not liable for pricing errors, order fulfillment issues, or any other consequences resulting from inaccurate information provided by you.

4. Products, Pricing, and Availability

All products listed on this Site are subject to availability. We reserve the right to discontinue any product at any time without notice.

Prices displayed on the Site are in U.S. Dollars and are subject to change without prior notice. N1 Flooring makes reasonable efforts to ensure pricing accuracy but does not guarantee that all listed prices are error-free. In the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price and to notify you promptly.

N1 Flooring does not provide flooring installation services. All product sales are for materials only. You are solely responsible for ensuring the suitability of any product for its intended application and for arranging professional installation if required.

5. Orders and Payment

By placing an order through this Site, you represent that: (i) all information you provide is accurate and complete; (ii) you are authorized to use the payment method provided; and (iii) your order complies with applicable laws and these Terms.

N1 Flooring reserves the right to refuse or cancel any order at its sole discretion, including but not limited to cases of suspected fraud, pricing errors, or product unavailability. If your order is cancelled after payment has been processed, a full refund will be issued to your original payment method.

6. Returns and Refunds

Subject to the conditions below, N1 Flooring accepts returns within 30 calendar days from the date of delivery.

To be eligible for a return, products must be:

  • In their original, unopened, and undamaged condition;
  • In original manufacturer packaging;
  • Free from signs of installation, cutting, or modification;
  • Accompanied by the original proof of purchase.

Non-returnable items include, but are not limited to: clearance or final-sale items, custom-order products, and any products that have been installed, modified, or damaged after delivery.

To initiate a return, you must contact N1 Flooring at the contact information provided in Section 14 of these Terms to obtain a Return Authorization Number (RAN) prior to shipping any product back. Returns submitted without a valid RAN will not be accepted.

Upon receipt and inspection of the returned product, N1 Flooring will issue a refund or store credit, as applicable, within 10 business days. Shipping costs associated with the return are the sole responsibility of the customer, unless the return is due to a defect or error on our part.

7. Limited Warranty

N1 Flooring offers a limited warranty on select products. Warranty coverage, duration, and terms vary by product and are set forth in the applicable N1 Flooring Product Warranty Document provided with your purchase or available upon request. Please contact us to obtain the specific warranty terms applicable to your product.

This limited warranty covers defects in materials and workmanship under normal use conditions and does not cover:

  • Damage resulting from improper installation, misuse, neglect, or accidents;
  • Normal wear and tear;
  • Damage caused by environmental factors, including but not limited to flooding, excessive moisture, or extreme temperature;
  • Products that have been altered, cut, modified, or repaired by parties other than N1 Flooring;
  • Incidental or consequential damages of any kind.

THE WARRANTIES SET FORTH IN THIS SECTION ARE THE SOLE AND EXCLUSIVE WARRANTIES PROVIDED BY N1 FLOORING. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

8. Communications, A2P Messaging, and Consent

8.1 Consent to Receive Communications

By providing your contact information (including phone number and email address) to N1 Flooring, you expressly consent to receive communications from us, including but not limited to: order confirmations, shipping updates, product promotions, and other marketing messages, via SMS/text message, email, and telephone calls.

Your consent to receive marketing communications is not a condition of purchase. Standard message and data rates may apply. Message frequency varies.

8.2 SMS / Text Messaging (A2P)

N1 Flooring uses Application-to-Person (A2P) SMS messaging to communicate with customers. By providing your mobile phone number, you consent to receive automated or pre-recorded text messages from N1 Flooring. These messages may include:

  • Order and delivery notifications;
  • Appointment reminders;
  • Promotional offers and marketing content;
  • General business communications.

To opt out of SMS messages at any time, reply “STOP” to any message you receive from us. After opting out, you will receive a single confirmation message and no further SMS messages, except as required for transactional or legal purposes. To opt back in, reply “START” at any time.

8.3 Email Marketing

If you have subscribed to our email list or provided your email address in connection with a purchase or inquiry, you consent to receive marketing and informational emails from N1 Flooring. You may unsubscribe at any time by clicking the “Unsubscribe” link in any marketing email or by contacting us directly. Transactional emails (such as order confirmations) are not subject to opt-out and will continue to be sent as necessary.

N1 Flooring complies with the CAN-SPAM Act and all applicable email marketing regulations.

8.4 Telephone Calls

By providing your telephone number, you consent to receive calls from N1 Flooring, including calls made using an automatic telephone dialing system or a pre-recorded or artificial voice, for marketing, informational, or transactional purposes, to the extent permitted by the Telephone Consumer Protection Act (TCPA) and applicable law. You may opt out of marketing calls by contacting us as provided in Section 14.

8.5 Data Not Sold

N1 Flooring does not sell, rent, trade, or otherwise transfer your personal contact information or communications data to third parties for their marketing purposes. Data may be shared with trusted service providers solely as necessary to deliver our communications and fulfill our obligations to you, subject to appropriate confidentiality obligations.

9. Intellectual Property

All content on this Site, including but not limited to text, graphics, logos, images, product descriptions, and software, is the exclusive property of N1 International Flooring LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes only. Any other use of Site content, including reproduction, modification, distribution, or commercial exploitation, without our prior written consent is strictly prohibited.

10. Disclaimer of Warranties

THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES AVAILABLE THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW. N1 FLOORING MAKES NO WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, N1 INTERNATIONAL FLOORING LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THIS SITE, ANY PRODUCTS PURCHASED THROUGH THIS SITE, OR ANY INSTALLATION-RELATED CLAIMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO N1 FLOORING FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless N1 International Flooring LLC and its members, managers, employees, agents, and contractors from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (i) your use of the Site; (ii) your violation of these Terms; (iii) your violation of any applicable law or regulation; or (iv) any misrepresentation of your customer category or account information.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction located in Fulton County, Georgia, to prevent irreparable harm pending arbitration.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against N1 Flooring.

15. Changes to These Terms

N1 Flooring reserves the right to modify these Terms at any time. When we make material changes, we will update the Effective Date at the top of this page and, where appropriate, notify you via email or SMS. Your continued use of the Site after any such modification constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

16. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy and any applicable Warranty Documents, constitute the entire agreement between you and N1 International Flooring LLC regarding your use of this Site and supersede all prior agreements and understandings.
